Abstract
The Law is divided into 11 Chapters: Title and Definition (I); Payment of Duties and Fees (II); Duties and Rights of Entrepreneurs (permissions for foreign fishermen) (III); Duties and Powers of the Director-general (IV); Duties and Powers of Inspectors (enforcement measures) (V); Duties of the Master (VI); Invalidity of Licence (VII); Appeals (VIII); Prohibitions (IX); Offences and Penalties (X); Miscellaneous (XI).
The entrepreneur shall submit an application in order to obtain a licence and be registered at the Department of Fisheries. He shall, inter alia, pay the fees as established by the legislation in force, comply with the provisions of the present Law and submit to the Department a list of the names of Burmese citizens appointed as fishermen or crew members. On the other hand, he shall have the right to purchase within the country equipment relating to fisheries, the right to apply for permission for loading, unloading, processing and transferring fish, etc. The Director-General shall exercise powers relating to the issuance, withdrawal of the licence and shall take any other necessary measures in case of contravention. The inspection of fishing vessels and other duties related thereto (e.g. stopping, boarding, searching fishing vessels, interrogating the Master and the crew, seizing dangerous substances, etc.) are entrusted to the Inspector. All the powers of the Master pertain to his fundamental obligation to comply with the provisions of the present Law; they include, among other matters, the keeping of vessel's log-book, the inspection of the vessel, etc. Final provisions concern prohibitions and offences and penalties.
