Abstract
This Law provides for the establishment of Intellectual Property Agency, registration of patents and protection of rights of patentees and inventors. Chapter I contains the short title and definitions. Chapter II lays down the objectives of the Law which includes protecting the rights and interests of the patentees and inventors. Chapter III establishes the Central Committee on Intellectual Property and lays down its functions. Chapter IV constitutes the Intellectual Property Agency (Agency) and states its functions. Chapter V provides for the functions of the Department in charge of intellectual property matters. Chapter VI gives the power to the Ministry of Commerce to appoint the Registrar and necessary Examiners in the Department and lays down their respective duties. Chapter VII and VIII list the patentable and non-patentable inventions, respectively.
Chapter IX contains the person entitled to apply for a patent. Chapter X lays down the procedure for application of patent and Chapter XI contains steps towards registration. Chapter XII recognises the right of priority. Chapter XIV provides the patent rights of patentee during the term of the patent. Chapter XV allows for transfer of patent rights and lays down the procedure for the same. Chapter XVI and Chapter XVII provide for licencing of patent and compulsory licences. Chapter XIX provides for registration of utility model. Chapter XX allows for international registration. Chapter XXI provides for appeals from decision of Registrar to the Agency. Chapter XXII establishes the Intellectual Property Courts. Chapter XXIV lays down the penalties
