Abstract
The Penal Code of Myanmar (Code) provides for the penalties and punishment committed by persons within Myanmar for every act or omission contrary to the provisions of this Code. The Code provides for punishment and penalties for offences committed, inter alia, in respect of property, human body, public health and safety, weights and measures etc. The Code includes penalties for fraudulent use of false weighing instrument (sec. 264), false weight or measure of length or capacity (sec. 265), and being in possession or selling instruments for weighing (sec. 266,267). Further, the Code lays down the punishment for negligent act likely to spread infection of disease dangerous to life (sec. 269); disobeying rule made for quarantine of vessels (sec. 271); adulteration of food or drinks meant for sale (sec. 272); sale of noxious food or drinks (sec. 273); adulteration of drugs (sec. 274); sale of adulterated drugs (sec. 275); fouling water of public spring or reservoir (sec. 277); and making atmosphere noxious to health (sec. 278). The Code also imposes penalties and punishment for harming animals (sec. 428); harming cattle (sec. 429); mischief by injury to works of irrigation, or supply of water meant for food or drink for human beings or animals (sec. 430); or any bridge or navigable river, channel (sec. 431); or drainage (sec. 432); or damage to agricultural produce (sec. 435).
