Abstract
The scope of this Law is to define, encourage, respect, protect, and provide conditions for the legal of status of human rights defenders, to cooperate, and to regulate relations concerning the structure, organization, and activities of the Human Rights Defenders Committee. The legal status of human rights defenders who have conducted or are conducting human rights protection activities in the territory of Mongolia shall be regulated by this Law. Human rights defender shall be intended a person who, alone or in association with others, conducts or participates in human rights protection activities. Human rights protection activities shall be intended the promotion of human rights and freedoms, non-violent and peaceful expression of opinion against acts or omissions that violate human rights and freedoms, and generally accepted norms of international law, to respect the principles and protect human rights in any mode. Protecting the rights of human rights defenders is aimed at preventing and stopping the violation of the rights and freedoms of human rights defenders by the government, people, legal entities, and any person united by certain interests, restoring the violated rights, and compensating for the damage caused by the role of government organization. The human rights defender shall adhere to the following principles in his activities: (a) to uphold the Constitution and other laws of Mongolia; (b) value fairness and humanity; (c) to be free from corruption and conflicts of interest; (d) not to discriminate; and (e) to respect the honor, glory, rights and legitimate interests of others. The human rights defender has the following full rights: (a) to promote and protect human rights and freedoms guaranteed by the Constitution, laws, and international treaties of Mongolia; (b) to influence the development, discussion, public awareness and acknowledgement of new understandings and principles of human rights; (c) to constitute associations, non-governmental organizations, alliances, associations, groups, and to participate in their activities; (d) communicate and cooperate with national and foreign national, regional and international organizations engaged in human rights protection activities; (e) to search, obtain, publish, store, and share with others information, other than those classified as confidential according to the law, from government organizations and legal entities in order to protect human rights and freedoms; (f) to draw public attention to draft laws and regulations in order to comply with the principles of human rights, to develop and discuss specific proposals, to submit them to legislators, to analyze the implementation of laws and policy documents, and to develop necessary recommendations; (g) to make suggestions, requests, complaints, draw attention to violations of human rights and illegal actions, and inform others about it; (h) to represent the person with the written consent of the person in order to promote and protect the rights and freedoms of the person; and (i) to file a complaint to the international human rights organization in accordance with the procedure stipulated in the relevant international agreement regarding the violation of the rights and freedoms of the government organization, official, and legal entity. State organizations, officials, and legal entities assume the following general duties related to the activities of human rights defenders: (a) to recognize and not violate the rights of human rights defenders; (b) to treat their activities with respect; (c) to create opportunities for non-violent and peaceful activities; (d) to provide necessary information; (e) to prevent actions against human rights defenders in any way without grounds stipulated by the law and, in case of violation of the rights of the human rights defender, to take promptly the necessary measures within the scope of the legal duties.
