Abstract
The scope of this Law is to ensure food security, promote free trade, and maintain natural balance by protecting plant health in the national territory. This Law shall apply to activities related to the protection of plant health, the prevention of the emergence and spread of plant pests, their control, and eradication. The following principles shall be followed in plant health and plant protection activities: (a) scientifically based development; (b) risk analysis of the harmful organisms; (c) reduction of pesticide use by using control methods that pose the least risk to humans, animals, and the environment; (d) ensuring information exchange, transparency and non-discrimination; and (e) aiming to remove barriers to trade in plants and plant products. The state administrative body responsible for plant protection shall classify harmful organisms as follows and approve their list: (a) prohibited harmful organisms; and (b) unregulated and quarantined harmful organisms. The list of prohibited harmful organisms shall indicate whether the harmful organism is particularly harmful. Except for use in the selection and development of varieties for official testing, experimentation, scientific or educational purposes, the introduction, relocation, storage, propagation and distribution of harmful organisms into the national territory is prohibited. If a sudden increase in a prohibited harmful organism is detected, the relevant person shall immediately notify the state administrative body responsible for plant protection. In order to prevent the spread of prohibited harmful organisms, the competent officials or authorized state bodies shall take immediate action under the supervision of the state inspector of the authorized body to implement control over agricultural production in agricultural fields, their forest strips, greenhouses, threshing floors, open fields, cellars, and warehouses. If it is determined that plants, plant products, and regulated substances and materials are contaminated with prohibited harmful organisms, the relevant party is obliged to immediately withdraw them from the market and take necessary measures. In the event of the detection of a prohibited harmful organism, the following officials and organizations shall establish and lift the border and quarantine of the outbreak area: (a) if the spread of a prohibited harmful organism covers the territory of one administrative territorial unit (soum) or district, or if conditions for unifying the foci of harmful organisms have not been met, the Governor of the administrative territorial unit (soum) or district, based on the conclusion of the state inspector of the authorized body for control in that locality; (b) if the territory of two or more administrative territorial units (soums) or districts is covered, the Governor of the province (aimag) or capital city shall base his/her opinion on the opinion of the state inspector of the authorized body for supervision in that locality; and (c) if conditions arise to merge the outbreaks involving railways, international airports, border crossings, or border crossing points, or in the territories of two or more provinces (aimags), the Government shall take action, based on the conclusion of the State Inspector General of the branch of the central state administrative organization authorized to implement control, and the proposal of the state administrative organization responsible for plant protection issues. Disinfection, disinfestation, and destruction of pests shall be carried out on areas with outbreaks of harmful organisms, vehicles, buildings, greenhouses, threshing floors, open areas, cellars, warehouses, other purpose-built equipment, and clothing, tools, and belongings of people who have entered the outbreak. Depending on the circumstances, the competent authority for control and the state administrative body responsible for plant protection shall submit its conclusions and proposals on the extension or cancellation of the quarantine to the official or organization that imposed the quarantine for decision.
