Abstract
The objective of this Law is to implement public-private partnership projects in the field of public infrastructure and public services, to support private sector participation and investment, to ensure long-term efficient cooperation between the public and private sectors based on optimal risk management in accordance with partnership agreements, and financial accounting, is to create a favorable legal environment in connection with the implementation of proper budget management. This Law applies to the planning, development, evaluation, and analysis of partnership projects to be jointly implemented by the public and private sector in the field of public infrastructure and public services, the selection of projects, the selection of private sector partners, and the conclusion and implementation of partnership agreements. The central state administrative organization in charge of partnership shall exercise the following powers within the framework of partnership: (a) to manage the partnership project development fund, to take necessary measures to form the finances of the fund, and to submit proposals to include the funds to be financed from the budget; (b) to organize the selection of private sector partners and the conclusion of partnership agreements; (c) to prepare an annual report on the implementation of partnership laws, partnership projects, and the fulfillment of contracts, and present them to the Government every year; and (d) to develop risk calculation and distribution methodology within the partnership.
