Abstract
This law aims to implement the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) within Mongolia. It governs how individuals, businesses, and organizations can obtain permits to trade internationally in animals, plants, and related products listed in the CITES appendices. The law applies exclusively to species and items listed in the convention and outlines the legal framework for compliance.
The law establishes two main bodies under the Ministry of Environment: the Management Authority and the Scientific Authority. These bodies are responsible for issuing permits, evaluating trade impacts on species survival, and reporting to the CITES Secretariat. The Management Authority handles administrative tasks, while the Scientific Authority provides expert assessments on whether trade would harm species or ecosystems.
The law prohibits commercial trade of species listed in Appendix I of CITES, allowing only limited non-commercial uses such as research or exhibition. Trade in species listed in Appendices II and III is permitted under strict conditions. It also details the process for obtaining permits, including scientific assessments and documentation requirements. Violations of the law can result in administrative or criminal penalties, and informants who report violations may be rewarded with a portion of the fines collected.
