Abstract
This Law is a legislative act concerning social health services. Its primary focus is to regulate the relationships, principles, and organizational structures related to social health assistance and services, aiming to promote health, prevent disease, and ensure access to health services across the population. The law operates within the broader national legal framework, referencing the Constitution, health, labor, and social protection laws, as well as international treaties to which Mongolia is a party. Its policy goals include safeguarding public health, promoting health education, and establishing a comprehensive, evidence-based approach to social health management. Key measures outlined include the classification of social health services into various types such as infectious and non-infectious disease control, environmental health, occupational health, food safety, mental health, reproductive health, and emergency response. The law specifies activities for each category, including surveillance, research, preventive measures, and public education. It emphasizes principles like transparency, scientific basis, non-discrimination, human rights, and public participation. The law also details the roles of government agencies, including the Social Health Council, and mandates the development of policies, data collection, and research activities, with specific responsibilities assigned to national and local health authorities. Financial provisions include funding from the state budget and supplementary sources like health insurance and charitable contributions, with mechanisms for service payment and resource allocation. Implementation mechanisms involve institutional responsibilities assigned to various health organizations, including the National Center for Social Health and regional health offices, with specified reporting timelines and coordination procedures. The law establishes procedures for stakeholder involvement, including citizens, enterprises, and media, to ensure transparency and public engagement. Enforcement is addressed through penalties for violations, with legal accountability specified for officials and entities that breach the law. Overall, the document provides a detailed legal framework for the organization, financing, and regulation of social health services in Mongolia, emphasizing institutional roles, procedural compliance, and stakeholder participation.
