Abstract
This Act makes provision with respect to the proper use, protection and restoration of water resources of Mongolia. Chapter I contains general provisions. Articles 3 to 7 provide for the monitoring and inventory of water resources (the "Water Reserve Resource") in Mongolia, and the determination of potential maximum quantity of water that may be taken from nature for a specific period without affecting the natural water balance ("potential use"). Water resources and potential use shall be determined by hydrological exploration by a "certified organization" (art. 4). A Water Monitoring Network and a Water Databank shall be set up in accordance with articles 5 and 6. Remaining articles of Chapter I contain principles of water use and set out powers of central and local authorities to protect water resources.
Chapter 2 specifies various measures to protect and restore water resources including the creation of water conservation zones, the adjustment of the amount of water that may be used for commercial purposes, water collection, and protection of water against pollution.
Chapter 3 regulates the use of water for household and commercial purposes. Article 17 concerns contracts for commercial water use. The application for such contracts shall be made to Soum and Duureg Governors in accordance with article 18. Contracts shall be concluded with the certified organization responsible for water management in the territory concerned (art. 20). Article 21 spells out basic conditions for commercial water use, whereas article 22 outlines rights and duties of water users.
The last Chapter contains miscellaneous provisions dealing with use of private water facilities, use of transboundary waters, prevention of disasters, use fees, incentivation of protection activities, and violation of provisions of the present Law. (30 articles)
