Prevention and Remedying of Environmental Damage (Amendment) Regulations, 2021 (L.N.217 of 2021).

These regulations shall be read and construed as one with the Prevention and Remedying of Environmental Damage Regulations (the principal regulations). The following sub-regulations of regulation 12 of the principal regulations are amended: sub-regulation (1) is substituted by a provision concerning the entitlement of natural or legal persons affected or having an interest or alleging an impairment, to submit observations on instances of environmental damage and to request the competetent authority to take action; sub-regulation (2) is substituted by a provision according to which any non-governmental organisation incorporated for the purpose of promoting environmental protection shall be considered as having a sufficient interest for the purpose of sub-regulations (1)(b) and rights capable of being impaired for the purpose of sub-regulations (1)(c); Sub-regulation (3) is reworded.
