Abstract
These regulations amend the Work in Fishing Convention Regulations ("principal regulations"). In particular, regulation 1 is modified to state the application of these regulations without prejudice to the provisions of the Merchant Shipping (Fishing Vessels) (Minimum Safety and Health Requirements) Regulations and the Merchant Shipping (Fishing Vessel Safety) Rules as well as without prejudice to the provisions applicable to seafishing vessels according to Council Directive 92/29/EEC of 31 March 1992 on the minimum safety and health requirements for improved medical treatment on board vessels: in case of conflict with those texts the present regulations apply.
Regulation 2 is reworded to reflect the change of some definitions.
Regulation 3 concerning the applicability (to all fisherman on board all fishing vessels and to all fishing vessels) of the regulations is substituted.
Regulation 5, concerning the requirement that all working fishermen have concluded a written fisherman's work agreement, is amended.
Regulation 6 is amended and new paragraphs are added basically concerning: on board procedures for the prevention, investigation and reporting of occupational accidents, injuries and diseases; personal protective equipment and basic safety training; knowledge of safety measures.
Regulation 8 concerning manning requirements is substituted.
Regulation 10 is revised and new paragraphs are added concerning necessary training for fishermen on the handling of fishing gear and on the necessity that vessels are stocked with adequate quantities of medical products and that fishermen are trained to their use and provided with relevant guides.
Regulation 12 concerning minors acting as fishermen is modified as well as regulation 13 concerning minors' night work.
Regulation 14 is amended also, concerning the requirement of a medical fit-for-work certificate to act as a fisherman on any Maltese vessel.
Regulations 15, 16 and 17 are reworded.
Regulation 20 regarding the application of a fishermen of a medical review of his case is reviewed. Regulation 28 on the rest hours for fishermen and regulation 31 on information on night duties are modified.
Regulation 25 is modified: it concerns the modification of collective agreements which may be authorized provided that the general principles for the protection of the health and safety of the fishermen are respected.
Regulation 28 on the rest hours for fishermen and regulation 31 on information on night duties are modified. Regulation 32 and regulations 34 to 56 are deleted.
Regulation 57 on repatriation is reviewed. Regulations 58 and 59 are deleted and so are regulations 61 to 71.
Regulation 60 is reworded and regulation 72 on the requirements inherent to the holding of a crew list is revised.
Regulation 73 on the minimum guidelines on food and weekly rations set out in Schedule IV is revised while regulations 74 and 75 are deleted and so are the headings "HEALTH AND SOCIAL WELFARE SERVICES" and "Owner’s liability for medical care".
Regulation 76 on mediacal assistance of fisherman on board and regulation 77 on liability of the vessel owner towards the fisherman are revised. Regulation 79 is deleted. Regulation 80 is modified, the heading "Complaints" is deleted, regulations 82 to 84 are deleted and a new regulation 88 on Radio and satellite communications is added.
