Abstract
This Act seeks to define a legal framework towards making Mauritius a climate-change resilient, and low emission, country. The document is divided into seven (7) parts: preliminary (I); interministerial council on Climate Change (II); Department of Climate Change (III); Climate Change Committee (IV); Climate Change measures (V); application of Act to Rodrigues (VI); and miscellaneous (VII).
The document defines the tasks and functions of several institutions regarding Climate Change governance. The Interministerial council on Climate Change, defined in Part II, is in charge of setting national objectives, goals and targets with a view to making Mauritius a climate change-resilient and low emission country. The Council shall have such functions and powers as are necessary to further its objects most effectively and shall, in particular: make climate change policies and set priorities for adaptation and mitigation in agriculture, biodiversity, coastal zones, infrastructure, the port, marine environment, tourism, fisheries, water and energy; monitor and review progress made by Government departments on climate change projects and programmes; ensure coordination and cooperation between Government departments, local authorities and other organisations engaged in climate change projects; and make such recommendations and issue such directives as it may determine to Government departments.
On the other hand, Part III establishes the responsibility of the Department of Climate Change to: promote adaptation and mitigation measures to address climate change in relevant sectors; develop and coordinate policies, projects, strategies, programmes and action plans to address the adverse effects of climate change and oversee their implementation by relevant stakeholders; formulate and update guidelines for the conduct of vulnerability and risk assessments relating to climate change; establish and maintain a climate change database system to enable the assessment, monitoring, reporting and verification of measures relating to climate change; prepare, in collaboration with relevant stakeholders, the National Inventory Report; promote and enhance the participation of stakeholders, including the business community, non-governmental organisations and local communities, in climate change matters; identify the particular and specific vulnerabilities of Mauritius, as a Small Island Developing State, to climate change, and measures to address them; and establish links, and cooperate, with Small Island Developing States and other regional blocks so as to mobilise resources to implement common mitigation and adaptation measures.
As for the Climate Change Committee, for the purposes of this act, it may where it considers necessary, co-opt such other person with relevant expertise as may be of assistance in relation to any matter before it. The Committee is also in charge of recommending: methods to monitor and control the emission of greenhouse gas in sectors such as agriculture, aviation, energy, industry, land use, forestry, transport and waste and such other relevant sectors; approaches for vulnerability and risk assessments and adaptation in agriculture, biodiversity, coastal zones and fisheries; approaches to monitor the adverse effects of climate change on human rights and vulnerable communities and their livelihood; and coordinate the use of resources and any assistance provided by donors and funding agencies.
Finally, regarding climate change measures, part V, divided in three sub paragraphes, regulates: the National Climate Change Adaptation Strategy and Action Plan, National Climate Change Mitigation Strategy and Action Plan and National Inventory Report (A); the duties and obligations of institutions (B); and reporting and public consultation (C). Under part VII, the document defines the National Implementing Entity and enforcement of the Act.
