Abstract
This Act applies where pollution damage is caused in the territory of Mauritius as a result of the discharge or escape of oil, in case the oil is used for the propulsion of an oil tanker, or it is carried in bulk as cargo. The Act defines the following relevant terms: bunker oil; certificate of insurance; crude oil; discharge of oil; established claim; Exclusive Economic Zone of Mauritius; group of companies; incident, as any occurrence resulting in the discharge or escape of oil from an oil tanker which causes pollution damage or a relevant threat of contamination; liability for pollution damage; pollution damage; territorial sea. The Act concerns the following matters: insurance and other security against pollution damage; liability for pollution damage by owner or other persons and exemptions; limitation of liability for pollution damage; claim for compensation for pollution damage; compensation and contributions to the International Oil Pollution Compensation Fund established by the Convention; limitation of liability pursuant to Fund Convention; contributions to supplementary fund; offences and jurisdiction.

An Act to give the force of law to the International Convention on Civil Liability for Oil Pollution Damage, 1992, to the International Convention on the Establishment of an International Fund for Compensation for Oil Pollution Damage, 1992 and to the Protocol of 2003 to the International Convention on the Establishment of an International Fund for Compensation for Oil Pollution Damage, 1992, and to provide for matters related thereto.
