Abstract
This Treaty between the Government of the Republic of Seychelles and the Government of the Republic of Mauritius is in respect of Joint Management of the Continental Shelf in the Mascarene Plateau Region. The Joint Management Area (JMA) is established in respect of the Joint Zone described in Article 2 of the Treaty Concerning the Joint Exercise of Sovereign Rights over the Continental Shelf in the Mascarene Plateau Region (Art. 3). A three-tiered joint administrative structure consisting of a Ministerial Council, a Joint Commission and a Designated Authority, is established (Art. 4). The Treaty provides for agreement between the parties in respect of sharing of revenue (Art. 5), taxation code (Art. 6), application of domestic law (Art. 7), natural resource codes (Art. 8), pipelines (Art. 9), unitisation of petroleum or mineral deposit (Art. 10), and the right to conduct surveys including hydrographic, geological, geophysical and seismic surveys to facilitate natural resource activities in the JMA (Art. 11). Further, the Treaty provides for protection of seabed marine environment and biodiversity (Art. 12), and carrying out biological surveys and to engage in bioprospecting (Art. 13). The provisions relating to employment, health and safety of workers, customs, migration and quarantine, criminal jurisdiction, safety and crewing regulations, surveillance and security measures and settlement of disputes are also contained in the Treaty.
