Abstract
These Regulations, made under provisions of Act No. 4/93 (Environmental Protection and Conservation Act), in compliance with the article 22 of the Constitution on the maintenance of the natural environment, biodiversity, and natural resources of the country, for the benefit of the present and future generation, provide thus for: sustainably protect and maintain the health of the wildlife in its living environment and the multiple benefits of natural resources; establishment of rules for the identification and management of naturally protected areas, in order to ensure the participation of all the involved parties; the identification of important species; compilation of list of endangered species and strengthening their protection at the national level; establishment of a database of the genetic resources for improving their national protection; increase community participation and awareness in the identification of naturally protected species; strengthening the methods of analysis of naturally protected species.
The Regulations cover the following matters: Ministerial determination of naturally protected species; reason and standards for designating a particular organism as naturally protected species, including: importance of the organism's role in the ecological system, impact of the possible extinction of any species on the vitality of the countries’ economic industries; preparation of management Plan for the protection of the species; exceptional circumstances in which the provisions of the Regulations do not apply, including: dangerous organism infecting a protected organism, capture of a naturally protected species, treatment of animals caught as bycatch, including organisms in fisheries; seizure of livestock by the responsible agency, and further release into the environment; registration of wildlife care and treatment centres; definition of standards for threatened, native and migratory species; violations, criminal offences and penalties; list of protected species, including: birds, reptiles, cartilaginous fishes; application for special permit relating to research on protected species.
