Abstract
This Act establishes the Energy Regulatory Authority and provides for the regulation and control of the production and distribution of energy of renewable and non-renewable sources.
The Energy Regulatory Authority is established as a body corporate. The Authority shall have power to regulate the activities of the energy industry in accordance with this Act and other energy legislation. It shall, among other things, grant licences for energy undertakings, monitor and enforce compliance by licensees with licences granted under this Act and other energy legislation, and arbitrate commercial disputes under this Act and other energy legislation. No person may establish, operate, carry on or be involved under licence involved in any manner in an energy undertaking in Malawi, without a licence issued by the Authority. In order to promote and fund rural electrification, every licensee shall pay to the Authority a rural electrification levy.
