Abstract
These Regulations implement provisions of the Fisheries Conservation and Management Act, 1997.
The 26 regulations are divided into 5 Parts: Preliminary (I); Beach Village Committees (II); Registration of local fishing vessels (III); Fishing licences (IV); Fishermen’s Associations (V).
Persons engaged in fishing in a particular fishing beach may form a Beach Village Committee under section 3 for purposes of conservation and management of fisheries resources within its area of jurisdiction as defined in articles 4 to 6. A Committee shall have the power to scrutinize applications for registration of local fishing vessels of small-scale commercial and subsistence fishing fishermen and applications for fishing licences by the same, to keep registration records and enforce fisheries resources conservation regulations and licence conditions, to seize vessels and fishing gear that are contravening provisions of the Fisheries Conservation and Management Act (art. 7). Articles 7 to 10 concern the internal organization of Committees. Application for registration shall be done to the Director through a Committee having jurisdiction. Fishing in an area under jurisdiction of a Committee shall be done only with a licence issued in accordance with articles 15 and 16. Large scale commercial fishing shall be prohibited in areas under jurisdiction of a Commission unless expressly authorized by the Director. Committees may form fishermen’s associations. Fishermen’s associations shall represent the interests of the fishing population in its area and advise the Board and the Director on fisheries conservation measures. (completed by 2 Schedules)
