Abstract
This Act amend and consolidate the law relating to the manufacture and sale of intoxicating liquor, to repeal the Intoxicating Liquor Act and the Traditional Beer Act. The Act is organised in thirteen Parts and a Shedule. After a first, preliminary, Part the second Part is dedicated to the administration issues concerning the definition of the licencing areas and the licencing officers (eligibility, functions, compensation, meetings etc.).
The third Part regards the licences; the procedure for the application , the different types of licences, the temporary or occasional licences etc.).
The fourth Part covers issues related to the issuance and the renewal of licences while the following Part regulates the transfer and removal of licences related to premises. The sixth Part concerns the appeals and the licencing appeals Tribunal.
The seventh Part applies to the brewing and sale of traditional beer and to the retail sale of opaque beer. Like a self standing Part in the middle of the Act, this Part provides for its own interpretation rules, at its point A. Point B is dedicated instead to the administration (local permit authorities, cklasses of liquor permits, retail and premises permit, application and refusal of permit, local authority beer-halls, where opaque beer may be sold to the public. It is also established that any local authority may make by-laws for the better carrying out of this Part.
The eight Part is related to offences (illegal manufacture of liquor for sale, illegal sales, sales outside permitted hours, Supply of liquor to young persons, employment of young persons to sell liquor, sale of liquor on credit by on-licensee prohibited etc. The following Part regulates the control of licensed premises (exhibition of name of licensee, restrictions on carrying on other business on licensed premises, improper storage of liquor, gambling on licensed premises etc). The tenth Part is abour the prevention and the detection of offences. A part on the forfeiture and the exemptions closes the document.
