Abstract
This Act establishes the Pesticides Control Board, makes provision for the registration pesticides and provides rules for the manufacturing, handling, storage, importation and placing on the market of pesticides. It also deals with related matters such as control of pesticide residues in food and matters of environmental concern.
The Pesticides Control Board is established as a body corporate and shall be responsible for the registration, control and management of all pesticides in Malawi and perform the functions assigned to it by this Act. The Board may establish one or more technical committees, to advise it in implementing the provisions of this Act.
No person shall import, manufacture or sell a pesticide which has not been registered under this Act and no person shall manufacture, export, distribute, store for sale, or sell a pesticide without a licence issued by the Board. The Act also provides rules for the packaging and labelling of pesticides, provides for inspection and enforcement, defines rules relative to manufacture and placing on the market of food or feed that may have excessive levels of pesticides or pesticides that are forbidden under this Act and grants regulation-making powers to the Minister for purposes of restricting use of pesticides in food, feed, or food or feed crops.
