Abstract
This Act regulates the search and production of petroleum; Part III regulates petroleum exploration license and petroleum production license. Part IV establishes that the holder of a petroleum production licence shall, in accordance with his licence and this Act, pay royalty in respect of petroleum recovered by him in the production area.
Part V contains provisions aimed at protecting the environment and work practices; in deciding whether or not to grant a licence and on the conditions to be included in a licence the Minister shall take into account the need to conserve and protect the natural resources in or on the land over which the licence is sought and in or on adjoining and neighboring lands. Moreover, the Minister may, pursuant to section 12 (2), require environmental impact studies to be carried out. In particular Division 2 recognizes civil liability for pollution. Section 63 considers some restrictions on exercise of rights in relation to certain land, for which is required consent of the lawful occupier (e.g. upon which there are growing, agricultural crops, including orchards or fuel-wood plantations) or consent of other Ministers (e.g. in respect of any controlled area under section 22 of the Water Resources Act, the written consent of the Minister responsible for water resources)
