Abstract
The Act is organised in VIII Parts; Part II establishes and disciplines functions of the Technical Advisory Committee, Plant Breeder’s Rights Department, and Registrar of plant breeder’s rights. Part III concerns application for and grant of plant breeder's rights; under the Act plant breeder’s rights shall be granted only in cases of a new variety of plant genera and species or in respect of new varieties of a preserved kind. The Act provides for refusal, appeal, objection, cancellation, surrender, etc. The holder of plant breeder’s rights may grant to any person exclusive or non exclusive licence relating to all or any of the rights provided; in granting any licence, the holder of the plant breeder's rights may impose such conditions, limitations or restrictions as he deems fit. The act then provides for offences, penalties, appeals and financing (establishment of Plant Breeder’s Rights Fund).
