Abstract
The scope of this Act is to provide for the regulation, promotion and development of the tobacco industry in Malawi.
The Act also provides for the establishment of the Tobacco Commission, which regulates and promotes the development of the tobacco industry (production, grading, processing, importation, exportation and marketing of tobacco; crop diversification and good agricultural practices in tobacco production; statistics and dissemination of information relating to the production, marketing, manufacturing and consumption of tobacco; regulation and enforcement of quality standards of tobacco; advisory of Government on policies and strategies to promote and develop the tobacco industry; administering of funds established pursuant to this Act). The Act sets the powers the Commission can rely upon for the accomplishment of its functions, defines its composition, functioning and financing.
The Act further regulates the use, sale, import into Malawi of seeds to be used for growing tobacco and sets limits on the use of pesticides. It also regulates the registration and duties of growers.
A whole Part is dedicated to contract farming, which can be funded or non-funded, and establishes the minimum terms and conditions to be included in a contract for tobacco farming and marketing. Also non-contract farming and marketing are regulated, in a different section.
Further, the Act gives consideration to the tobacco grower's associations, to tobacco transporters, to the licensing of buyers, to the regulation of tobacco graders; its sets minimum prices for the sale and regulates the sale at licensed tobacco floors, the allocation of production quota and of delivery quota as well as the excess of tobacco.
