Abstract
This Act provides for the establishment of the Board of Veterinary Surgeons; the registration and disciplining of veterinary surgeons and para-veterinary surgeons; the licensing of private practice of veterinary surgery and generally for the control and regulation of the practice of veterinary surgery and veterinary medicine in Malawi.
The text is made of 9 Parts and a Schedule concerning the operations, treatments, tests, advice, diagnosis and attendance which may be performed, given or provided by unregistered persons.
After Part 1 concerning preliminary and interpretation issues, Part 2 is dedicated to the Board of Veterinary Surgery, the sole registering authority of all the persons required to be registered under this Act. This Part concerns its establishment, composition, proceedings, committees, tenure, functions, policy directions, protection of members etc.
Part 3 concerns the management, in particular the appointment of the Registrar, which is the secretary to the Board and to every committee thereof.
Part 4 concerns the financing of the Board (its funding, any possible levy that the Board can impose, the financial year, accounts, reports).
Part 5 covers the registration as a veterinary surgeon or as a para-veterinary surgeon and all related issues: the application, the prohibition from practising for unregistered persons, the registry, the eligibility and qualifications to be registered, the use of title etc.
Part 6 concerns the regulation of the private practice: the licence for it, its issue, cancellation, withdrawal etc.
Part 7 is about the disciplinary provisions concerning the registered persons, including the regulation of Disciplinary Committee of the Board, its institution, composition and functions.
The text is closed by Part 8, dedicated to Offences and penalties and Part 9, providing for the Regulations that the Minister may make to give effect to the provisions of the Act.
