Abstract
Section 35 (1) of the Environmental Quality Act 1974 (No. 127) establishes that any person who is aggrieved by (a) a refusal to grant a licence or transfer of a licence, (b) the imposition of any condition, limitation or restriction on his licence, or (c) any decision made by the Director-General under the same Act may appeal to the Appeal Board. The Appeal Board is appointed by Section 36 of the Act. The present Regulations have been adopted by the Minister to lay down further provisions as regards the appeal procedure, covering in particular the time within which the person concerned may submit his notice of appeal. Regulation 4 defines specific powers of the Appeal Board, whose orders shall be final and no appeal shall lie from it (Reg. 5).
