Abstract
The present Act provides for the setting up of the Malaysian Cocoa Board for the following purposes: (a) promotion and development of the cocoa industry in Malaysia; (b) administration of the cocoa industry in Malaysia. The Act is divided into the following Parts: (I) Preliminary; (II) The Board; (IIA) Director-General and staff of the Board; (III) Finance; (IV) Cess; (V) Audit and annual report; (VA) Enforcement; (VB) General; (VI) Supplementary and transitional provisions. Two schedules are attached.
The Malaysian Cocoa Board shall exercise the following functions: (a) promotion and performance of research with respect to the production, processing, storage, transportation, marketing, consumption and uses of cocoa and cocoa products; (b) acquisition, holding or granting of rights in connection with the research findings; (c) control and co-ordination of the activities and policies of all research and development organizations financed from the Fund set up under Part III; (d) collection and dissemination of cocoa and cocoa products; (e) providing with technical, advisory and consultancy services to the cocoa industry; (f) regulating, on the one hand, of the manner of storing and shipping of cocoa and cocoa products and, on the other hand, the processing, grading, packaging, imports and exports of cocoa. Section 9 regulates the powers which are entrusted to the Board. Further, the Malaysian Cocoa Board Fund is established by section 18. The Fund shall be maintained and administered by the Board.
