Abstract
This Enactment is formulated by the Legislature of the State of Sabah. The Text consists of 119 Sections divided into 15 Parts. The first Schedule gives the lists of prohibited species, protected species, and control species. The second Schedule gives the list of fish diseases. The third Schedule gives the lists of prohibited gears. The fourth Schedule gives the list of protected plants.
There shall be a Director of Fisheries who shall be appointed by the State Public Service Commission. The Director shall prepare and keep under continual review fisheries plans and aquaculture development plan. The Minister may designate or declare an area to be an Aquaculture Industry Zone. Any person who intends to set up an aquaculture premise shall obtain a permit. Before the Director issues a permit, the Director may require the applicant to submit a copy of such environmental impact assessment report. Licenses shall be obtained in respect of fishing stakes, fish-aggregation device or fishing appliance for fishing in riverine waters according to Section 21. The Director may appoint authorised officers or members of the village or local community in the Community Fisheries Management Zone, to form a Community Fisheries Management Zone Committee to administer and undertake the management and conservation of the fisheries resources or the fisheries of the said Community Fisheries Management Zone. The Director may declare an area where there is an outbreak of fish disease to be a designated control area and may prescribe the geographical limits thereof. The Enactment further make provisions for: prohibition on the use of fishing appliance pushed or towed etc., import and export permit of live freshwater fish, prohibited species not to be cultured, protected species not to be fished, controlled species not to be cultured without a permit, unlawful release of non-indigenous species, protection of fish habitats, fish sanctuary, inspection, offences and penalties, etc.
