Abstract
This Ordinance is enacted to regulate the conservation, protection, development and management of water resources of the Sarawak State and the supply and distribution of water and for matters connected therewith and incidental thereto. The Ordinance consists of 53 Sections divided into 8 Parts.
Sections 3-4 provide for the establishment of the Sarawak Water Resources Council, and objects and functions thereof. Section 11 lists the prohibited activity in a water catchment area. No person shall abstract groundwater or cause or permit any person so to abstract any such water from any source of supply or within a catchment area, except in pursuance of a licence granted by the State Water Authority and in accordance with the terms and conditions imposed on such licence. No licence may be issued unless the groundwater abstracted complies with the standard of safe drinking water determined by the health authority or has not been contaminated or unless the licensee undertakes in writing that none of the water abstracted under licence will be used for human consumption.
Sections 16-17 provide for the establishment, and functions and duties of State Water Authority. In order to be engaged in supply water for public consumption, a licence issued by the State Water Authority shall be obtained. A statutory water company shall be subject to the general supervision and control of the State Water Authority and shall undertake the supply and distribution of water to consumers under a licence to be issued by the State Water Authority.
The Ordinance further make provisions for: abstraction of groundwater to be certified as safe for drinking; construction and connection of supply pipes and fittings; unlawful connection of water supply; measurement of water supplied; offences and penalties; etc.
Entry into force notes
This Ordinance shall come into force on the 1st day of January, 1998.
