Decree No. 16/2012 approving the Regulation on guidelines for the contracting, implementing and monitoring process of public-private partnerships, large-scale projects and business concessions.

This Decree approves Regulation on the guidelines for the contracting, implementing and monitoring process of public-private partnerships (PPP), large-scale projects (PGD) and business concessions (CE). This Regulation, consisting of 74 articles divided into eight Chapters, establishes the procedures applicable to all the contracting, implementation and monitoring process of PPP, PGD and CE carried out in the country, under the initiative or under the decision and control of central, provincial and district levels, as well as local authorities, defining their framework and regulating the institutional framework, process and process phases, guarantees and incentives, contracts, prevention and mitigation of risks in PPPs, Sharing of benefits and irregularities and administrative treatment. The Regulation is divided as follows: General provisions (Chap. I); Institutional Framework, Process Phases and Process (Chap. II); Guarantees and Incentives (Chap. III); Contracts (Chap. IV); Prevention and mitigation of risks in PPP (Chap. V); Benefit sharing (Chap. VI); Irregularities and administrative treatment (Chap. VII); and Final provisions (Chap. VIII).
