Import and Export Control Act 30 of 1994.

The Import and Export Control Act 30 of 1994 provides a framework for regulating the import and export of goods in Namibia. The Act grants the Minister of Trade and Industry the authority to prohibit or regulate the import and export of goods through notices published in the Gazette. These notices can specify conditions under which goods may be imported or exported, including the quantity, value, price, and destination of the goods. The Minister also has the power to cancel, amend, or suspend permits if conditions are not met or if it is in the public interest. The Act requires individuals involved in the import, export, manufacture, or trade of goods to furnish information to the Minister upon request. Non-compliance with the Act, including importing or exporting goods without a permit, failing to comply with permit conditions, or providing false information, constitutes an offence. Offenders may face fines, imprisonment, or both, and the goods involved may be forfeited to the state. The Act also grants jurisdiction to magistrate's courts to impose penalties prescribed by the Act. It repeals the Import and Export Control Act of 1963, with actions taken under the previous Act deemed to have been taken under the new Act.
