Abstract
These Regulations, which are made in terms of the Access to Biological and Genetic Resources and Associated Traditional Knowledge Act (No. 2 of 2017) and to it they must refer for their interpretation, are composed of 6 Parts. After preliminary Part 1, Part 2 sets the functions of the Office, establish branch offices,regulates the establishment, by the Office, of research and development facilities.
Part 3 concerns the prior informed consent, the application for access permit, the bioprospecting activities, the period of validity of access permit, the renewal of access permit, the revocation or cancellation of access permit, the research promoting and encouraging conservation and sustainable use of biological diversity.
Part 4 is about the access and benefit sharing agreements and the benefits arising from biological and genetic resources held by State.
Part 5 concerns the material transfer agreements while Part 6 designates checkpoints to execute the monitoring obligations of Namibia in terms of the Nagoya Protocol; regulates the appeal to the Minister and to the High Court as well as the modes to pay fees.
