Abstract
This Charter sets standards and establishes the groundwork for the promotion and protection of human rights within African States members of the Organisation of African Unity. The Charter is composed of three Parts: I) Rights and duties; II) Measures of safeguard; III) General provisions.
The parties shall recognize the rights, duties and freedoms enshrined in the Charter and shall undertake to adopt legislative or other measures to give effect to them. An African Commission on Human and Peoples’ Rights shall be established within the Organisation of African Unity to promote human and peoples’ rights and ensure their protection in Africa (see arts. 30-59).
The following rights are included: Right to Freedom from Discrimination (art. 2); Right to Equality before the Law and Equal Protection of the Law (art. 3); Right to Property (art. 14); Right to Health (art. 16); Protection of the Family and Vulnerable Groups (art. 18); Right of All Peoples to Equality and Rights (art. 19); Right to Free Disposal of Wealth and Natural Resources (art. 21); Right to Economic, Social and Cultural Development (art. 22); Right to a General Satisfactory Environment (art. 24).See also article 20, which states that all peoples shall have the right to existence. They shall have the unquestionable and inalienable right to self-determination. They shall freely determine their political status and shall pursue their economic and social development according to the policy they have freely chosen. Colonized or oppressed peoples shall have the right to free themselves from the bonds of domination by resorting to any means recognized by the international community.
On gender issues, it is worth recalling paragraph 3 of article 18: "The State shall ensure the elimination of every discrimination against women and also ensure the protection of the rights of women and the child as stipulated in international declarations and conventions."
