Abstract
These Regulations, in exercise of the powers conferred on it by regulation 118 of the Gibraltar Merchant Shipping (Safety, etc.) Act, 1993 and all other powers enabling, the Government, for the purposes of transposing into the law of Gibraltar Directive 2002/59/EC of the European Parliament and of the Council establishing a Community vessel traffic monitoring and information system and repealing Council Directive 93/75/EEC, here provide for necessary implementation terms as regards the Community vessel traffic monitoring and information-reporting systems and related procedures.
The text is divided into 28 Regulations, as follows: Title and commencement; Interpretation; Application of these Regulations; Competent authority; Notification prior to entry into port; Mandatory ship reporting system; Use of ships’ routing system; Vessel traffic services within territorial sea; Vessel traffic services outside territorial sea; Requirements to use Automatic Identification Systems; Use of automatic identification systems (AIS) by fishing vessels; Use of systems for the long-range identification and tracking of ships (LRIT); Voyage Data Recorder (VDR) systems; Notification by ships carrying dangerous or polluting goods; Exemption; Information requirements concerning the transport of dangerous goods; Reporting of incidents and accidents at sea; Measures to be taken in the event of exceptionally bad weather or sea conditions; Measures in the event of risks posed by the presence of ice; Measures to be taken in the event of incidents or accidents at sea; Obligations of owners in relation to accidents and incidents; Competent authority for the accommodation of ships in need of assistance; Plans for the accommodation of ships in need of assistance; Decision on the accommodation of ships; Financial security and compensation; Marine casualty investigation; Broadcasting and supply of information; Transmission of information concerning hazardous ships; Confidentiality of information; Gibraltar’s communication system; SafeSeaNet and SafeSeaNet systems; Offences; Defences; Offences due to the fault of another person; Offences by corporate bodies; Inspection and detention of ships; Appeal.
