Abstract
These Rules are made in exercise of powers conferred by clause (d) of section 76 and section 76-A of the Indian Forest Act, 1927. They require all wood-based industry to obtain a licence for establishment, expansion and operation and furniture units must be registered. Further, consent to establish or operate from the Jammu and Kashmir Pollution Control Committee/Board must be obtained and no wood-based industry can be set up within 8 kms from the boundary of any reserved forests.
The procedure to obtain such licence or certificate of registration and renewal thereof are laid down. Every owner of wood-based industry and furniture units shall maintain records of receipt and disposal of timber in the form provided under the Rules. Forest Officers are given powers to inspect premises, search and seize raw materials or finished goods if there are reasons to believe that contravention of the Act, or of these Rules, or condition of licence/certificate of registration has been or is about to be committed. The licensing authority may cancel or suspend such licence or registration. Any person who contravenes any of the provisions of these rules, is liable to be punished by the competent Magistrate with imprisonment or fine, or both.
