Abstract
This Regulation of the Government of Greenland establishes rules for municipal councils to create local bylaws on noise protection under the Environmental Protection Act. It allows municipalities, with prior approval from Naalakkersuisut (the Greenland Government), to set binding limits on noise levels (measured in decibels and by specified calculation methods), classify types of noisy activities, and impose geographical and temporal restrictions. The regulation excludes rescue operations, police, and defense activities, and in areas where other laws apply, the strictest rules prevail. Naalakkersuisut may grant exemptions in special cases, subject to conditions, for up to two years, and may revoke them if violated or environmentally harmful. Municipal councils are responsible for supervision, issuing orders and prohibitions where bylaws are not respected, and may require measures such as limiting operations, closing windows/doors, or restricting noisy work to certain periods. Decisions can be appealed under the Environmental Protection Act. Non-compliance with orders, prohibitions, or exemption conditions may result in fines, including against legal persons, with revenues going to the state treasury. The regulation does not apply to major polluting industries or large construction projects regulated separately.
