Abstract
These Regulations apply in relation to seed of the plants in the first column of the table in Schedule 1 intended to be used for agricultural or horticultural production, but do not apply in relation to seed intended to be used for ornamental plants. They do not apply in relation to seed intended for export to a third country (other than regulation 28 which relates to certification for export). Categories of seed identified in the Regulations are> (a) breeder s seed ( BR ); (b) pre-basic seed ( PB ); (c) basic seed ( BS ); (d) certified seed ( CS ); (e) certified seed, first generation ( C1 ); (f) certified seed, second generation ( C2 ); (g) certified seed, third generation ( C3 ); (h) commercial seed ( CM ); (i) standard seed ( ST ).
Under these Regulations seed can only be marketed if it is certified, packaged, sealed, and labelled according to the regulations. There are specific categories of seed, such as breeder s seed, basic seed, and certified seed, each with its own standards and requirements for marketing. Certain operations, like marketing, packing, and labelling of seed, require a license from the Department of Environment, Food and Agriculture. Licenses are also necessary for crop inspectors, seed samplers, and testing stations, ensuring they are competent and meet the required standards. The Department may grant exemptions for temporary experiments under specific condition.
