Abstract
These Regulations, in accordance with the provisions of the national Nature Protection Act 1991, and after having consulted the Gibraltar Nature Conservancy Council, are here setting the Tuna fish protection and fishing control provisions, as regards several related topics such as permits, administrative and technical conditions and fish size standards, fishing season, scientific research, and possible offences and consequential penalties. These Regulations apply to any land covered (continuously or intermittently) by waters and all of the sea within British Gibraltar Territorial Waters.
This text is divided into 15 Regulations, as follows: Title and commencement; Scope; Interpretation; Tuna fishing permit; Conditions applicable to all tuna fishing permits; Additional conditions; Exemption for certain imports; Total Allowable Catches (TACs); Open and closed seasons; Suspension of Open Season; Study of tuna; Duplicate permits etc; Duty to produce permit etc; Revocation of permit; Offences and penalties.
The principal scope of this text is here described (Regulation 2(1) of this text: “With a view to the protection of wild tuna these Regulations provide for their exploitation in a manner consistent with scientific principles of preservation and conservation and in accordance with any applicable international obligations”.
Schedules 1 and 2 are also part of this publication (Tuna fish species scientific specifications and size; Administrative form-Declaration of catch).
