Adamawa State Water Supply and Sanitation Services Law, 2024.

This Law, divided into fourteen parts and consisting of 127 sections, provides for creating a framework for water supply and sanitation services in the State of Adamawa and for relating matters. The Law applies to: Adamawa State Water Services Regulatory Commission; private sector participation and service providers; Adamawa State Water Corporation; Adamawa State Small Towns Water Supply and Sanitation Agency; Adamawa State Rural Water Supply and Sanitation Agency; Ministries, Department and Governmental Agencies. The objective of this Law is to promote and ensure the right of every person in Adamawa State to have access to efficient, effective and sustainable water supply and sanitation services, by providing for: (a) the right of access to basic sanitation and basic potable water supply, necessary to secure sufficient water and an environment not harmful to human health or well-being; b) the setting of norms and standards for service provision for tariffs in respect of water supply and sanitation services; c) the preparation and adoption of water services development plans; d) the establishment of Water Supply and Sanitation service delivery utilities; e) interventions in the management, development and utilisation of water resources; f) the establishment of a Water Supply and Sanitation Service Management system; g) the promotion of effective water resource management and conservation; h) promoting private sector participation in water supply and sanitation services. Part II of the Law concerns administration and planning and focuses on: powers of the commissioner; declaration of disaster emergency situation.
Part III concerns the establishment of the Adamawa State Water Services Regulatory Commission and the specification of its functions and objectives, including: promoting and enforcing all State legislation and water policies, ensuring optimal utilisation of water resources in the State, maximising access to water services in rural areas, providing standards relating to plants and equipment pertaining to water supply and sanitation services, establishing guidelines for private sector participation in the development and management of water services, establishing community management arrangements in urban, rural areas and small towns, ensuring water conservation measures, development of water tariff strategy; measures for the protection of a catchment, or a geographic area; funds of the Commission. Further Parts focus on: private sector participation; establishment of the Adamawa State Water Corporation, of the customer care centre and definition of their functions; measures concerning land acquisition for any waterworks; establishment of the Adamawa State Water Supply and Sanitation Hygiene Agency and specification of its objectives, functions and powers; maps of waterworks and sanitation infrastructures; payment for water services; establishment of the Adamawa State Rural Water Supply and Sanitation Agency and specification of its functions and objectives; service providers and their responsibilities; agreements and contracts for water supply and sanitation services; licensing of utilities and service providers; compulsory acquisition of land; construction of waterworks and relating facilities; establishment of a trust fund for water supply and services; enforcement measures; offences regarding: diverting water, water pollution, bathing in waterworks, hindering or assaulting officials; legal proceedings.
