Anambra State Water Supply and Sanitation Law, 2015.

This Law, divided into nine parts and consisting of 154 sections, provides a framework for water supply and sanitation services management in the Anambra State. The objectives of this Law concern the following topics: the right of access to basic water supply and the right to basic sanitation necessary to secure sufficient water and an environment not harmful to human health or well-being; the setting of standards and norms for service provision and standards for tariffs in respect of water services; preparation and adoption of water services development plans by the Ministry responsible for water resources; a regulatory framework for water services institutions and other water services providers; the establishment of State water supply service delivery Agencies, their powers and duties; the formulation, monitoring and review of the Anambra State WASH Policy for the water supply and sanitation services; coordination of intervention in water and Sanitation delivery by Federal, State and Local Governments; gathering and dissemination of information on the water and sanitation matters; promotion of effective water resource management and conservation particularly for water within the constitutional authority of the State; collaboration of the Sector institutions with other National and State Agencies in the development of water and sanitation services. The Law defines the following relevant terms: water abstraction; basic water supply; consumer; distribution system; domestic supply of water; emergency situation; integrated water resources management; groundwater; water pollution; water services; water consumer associations; water quality standards; water services provider; waterworks.
Matters covered by this Law include: principles for water supply and sanitation services delivery in the State; urban water supply service framework; establishment of the Anambra State Urban Water Supply Asset Holdings Corporation; powers and functions of the Corporation; staff of the Corporation; functions of the Secretary; financial provisions and funds and resources of the Corporation; establishment of the Small Town Water Supply and Sanitation Agency, specification of its objectives, including: defining programmes for the empowerment and building of capacity to undertake the management of the water and sanitation facilities, undertaking the construction, rehabilitation and supervision of the construction of water supply facilities in the small towns, ensuring conservation and protection of the water resources of the State; functions and powers of the Agency; staff of the Agency; roles of water consumer associations; establishment and functions of the rural water supply and sanitation agency; powers of the agency including: providing guidelines on the management of water resources, supervising the construction and sinking of boreholes and other waterworks, improving traditional sources of community water supply, promoting private sector participation in the water supply and sanitation industry; appointment and powers of the staff of the agency; role of government and powers and responsibilities of the Ministry responsible for water resources; preparation of draft water services development plans; duties and powers of the local government; establishment of the Anambra State Water Supply Services Regulatory Commission; objectives of the Commission; special regulatory functions of the Commission; water quality standards and water tariffs; terms and conditions for the provision of water services; rights of water services providers; complaints, investigation and abatement orders; issuance, suspension and revocation of licences; sanitation and environmental provisions; prevention of water pollution and promotion of sustainable forestry practices, agro-forestry, reforestation programmes, appropriate agricultural land use methods, soil conservation, control and minimisation of the use of agricultural pesticides; general land use planning; offences and penalties.
