Climate Change Act, 2021.

This Act, consisting of 36 articles and divided into eight parts, concerns a framework for mainstreaming of climate change actions and applies both to governmental institution, public and private entities; provides for a system of carbon budgeting and establishes the National Council on climate change.
Part I defines objectives of this Act, including: allowing Nigeria to achieve its long-term goals on climate change mitigation and adaptation, through actions and programs coordinated and integrated with national development priorities and environmental policies; setting a target for years 2050-2070 for a net-zero greenhouse gas emissions; identifying risks and dangers, strengthening adaptive capacities to the impacts of climate change; promoting a low carbon economy with proper measures; ensuring a full cooperation between public and private entities in the field of climate change strategies.
Part II establishes the National Council on Climate Change, empowered to make policies and decisions on all matters concerning climate change, following the objectives of the Act; specifies its composition, its powers and functions.
Part III concerns the administration and control of the National Council, details the appointment of the Director-General and of the Council’s principal officers, specifies powers and functions of the Secretariat, including: advising, collaborating with the Ministries, monitoring and reporting on the progress of the implementation of the Act’s goals.
Part IV, concerning financial provisions, provides for a Climate Change Fund, which collects sums, subventions and grants and donations, funding from International Organisations, fines and charges from private and public entities, carbon tax and emission trading. The Fund is used for the payment of salaries and other emoluments of members of the Council, for funding new climate change mitigation projects, for conducting assessment of climate change impact on vulnerable communities.
Part V concerns the establishment of a carbon budget, aiming at controlling and limiting the temperature increase according to Nigeria’s international obligations; and the formulation of the National Climate Change Action Plan which establishes national goals, objectives and priorities on climate adaptation, and prescribes proper measures to assess risks and impact of climate change on environment and population, to enhance energy conservation and the efficient use of renewable energy.
Part VI concerns climate change obligations of Ministries, Departments and governmental Agencies and of public and private entities, including the integration of climate change into all educational levels.
Part VII provides for promotion of nature-based solutions to reducing greenhouse gas emission and mitigating climate change issues in the country, including measures for sustainable management of forests.
Part VIII provides for miscellaneous provisions: Council power to make regulations on the subjects of the Act; offences; interpretation of relevant terms, including: climate, climate change, climate change duties, climate change resilience, emissions, the list of greenhouse gases.
