Ebonyi State Environmental Protection Agency Law, 1999 (CAP. 53) .

This Law (CAP. 53) is enacted to establish the Ebonyi State Environmental Protection Agency (EBSEPA) as a corporate body responsible for coordinating environmental policies, monitoring pollution, managing waste, and enforcing environmental standards. The Law outlines the Agency’s powers to regulate air and water quality, control hazardous substances, oversee land conservation, and enforce noise limits. It also mandates environmental impact assessments for major projects and provides for technical assistance, public education, and inter-agency collaboration.
The Law further establishes enforcement mechanisms including compliance monitoring teams, powers of arrest and seizure, and penalties for violations. It creates a dedicated Environmental Protection Court with exclusive jurisdiction over environmental offences and outlines its composition, procedures, and powers. Local Government Environmental Protection Committees and Zonal Offices are also instituted to decentralize enforcement and community engagement.
