Abstract
This Ebonyi State Environmental Protection Law, 2015 (Law No. 009) establishes a comprehensive legal framework for environmental governance in Ebonyi State, Nigeria. It repeals the earlier 2009 Environmental Protection Agency Law and creates the Ministry of Environment as the central authority responsible for environmental protection, biodiversity conservation, and sustainable development. The Ministry is empowered to regulate water and air quality, manage waste, enforce pollution controls, oversee environmental impact assessments, and coordinate with federal agencies like NESREA. It also has authority to accept grants, borrow funds, and enforce compliance through inspections, penalties, and legal proceedings.
The Law introduces strict standards for industrial pollution, noise control, hazardous waste management, and land conservation. It mandates the establishment of an Environmental Protection Court with jurisdiction over environmental offences, and sets up Local Government and Zonal Environmental Protection Committees to decentralize enforcement and community engagement. The Law outlines penalties for individuals and corporate bodies violating environmental regulations, and empowers the Ministry to seal premises, prosecute offenders, and recover costs for environmental restoration.
