Ekiti State Public Private Partnerships Law, no. 12 of 2011

This Law, consisting of 28 sections, provides for the establishment of public private partnerships office in Ekiti State and related matters. The Law attributes the following objectives to the office: developing and maintaining public infrastructure of public assets and providing social amenities and other facilities through Public Private Partnerships in the State; providing appropriate regulatory framework for the evolvement Public Private Partnership in the management of public infrastructure or public assets in the state; coordinating policies and programmes that will promote and sustain Public Private Partnerships for the provision and development of public infrastructure or public assets in the State. According to the Law, the Office: collaborates with appropriate Government Institution organs or bodies in conducting pre-qualification process for private investors willing to enter into Public Private Partnership; initiates procurement of Public Private Partnerships for the development of public infrastructure and public assets; advises the Government on matters relating to financing, construction and maintenance of public infrastructure or public assets by means of Public Private Partnerships in the State and in particular with respect to the acquisition of land required for such purposes.
Other matters covered by the Law include: power of the Office; approving authority; procurement of public private partnerships; appointment of director general and other staff of the Office; establishment of special purposes companies or limited liability partnerships; inspectorate department; appeal from decision of the Office; financial provisions; application of the funds; designation of public infrastructure assets; authorisation to collect user fees of tolls; offences and penalties; power to make regulations; interpretation of the following terms: concession; project agreement; public asset; public infrastructure; road, inlcuding: water table and waterways.
