Electricity Act 2023.

This Act, consisting of 233 articles and divided into 22 Parts, provides for: consolidating the Laws relating to the Nigerian electricity supply industry; defining a comprehensive legal and institutional framework for the power sector in Nigeria in the areas of electricity generation, transmission, distribution, supply; strengthening consumer rights and protection; improving the exploitation of renewable energy sources; attracting investments; improving access to electricity in rural, unserved, peri-urban and urban areas through the use of conventional sources and renewable energy off-grid and mini-grid solutions; improving indigenous capacity in technology for renewable energy sources; promoting public education on renewable energy production and consumption. Part II of the Act concerns: governmental preparation and publication of the Integrated National Electricity Policy and Strategic Implementation Plan, in order to: promote the development of the electric power sector and the sustainable utilisation of coal, natural gas, nuclear substances and renewable energy sources; improve energy distribution in rural areas; increase public private partnerships for provision of access to electricity to all areas. This Part also concerns supervisory powers of the Minister and functions of the Minister responsible for energy and electric power, including: promoting the use of biomass for electricity generation; promote the development and exploitation of conventional and renewable energy sources, by harnessing opportunities offered under clean development mechanism and other mechanisms including carbon credit trading.
Part III concerns the development of a competitive National electricity market and includes: declaration of competitive electricity market; competition during the post-privatisation stage. Part IV concerns the incorporation and licensing of Independent System Operator (ISO). Part V provides for establishment, functions and powers of the Nigerian Electricity Regulatory Commission, including: maximising access to electricity services; ensuring adequate supply of electricity to consumers; ensuring fairness of the prices charged by licensees to consumers; ensuring the safety, security, reliability, and quality of service in the production and delivery of electricity to consumers; creation of a special fund of the Commission. Part VI concerns licensing, general duties, authorised persons to generate and transmit electricity. Part VII concerns generation of electricity and promotion of generation of renewable energy.
Part VIII focuses on the establishment of the National Hydroelectric power producing areas development commission, and includes matters related to its functions and duties. Further Parts concern: transmission of electricity, including public-private partnerships to facilitate transmission of electricity within the country; distribution and supply of electricity; tariffs and subsides; acquisition of land and land access right for electricity projects; consumer protection and licensee performance standards; competition and market power; the power consumer assistance fund; establishment of rural electrification agency; renewable energy and energy efficiency; Nigerian electricity management services agency (NEMSA); National power training institute of Nigeria; offences and penalties; miscellaneous and supplementary provisions.
