Abstract
These Regulations, made under sections 7(e), 10(f), 104-106 of the Petroleum Industry Act, No. 6, 2021, provide for: reducing environmental and social impacts associated with gas flaring and venting of natural gas and fugitive methane emissions into the atmosphere; protecting the environment; preventing waste of natural resources; enhancing energy transition; creating social and economic benefits from gas flaring and venting. The Regulations apply to licensees, lessees and producers of gas in the upstream petroleum operations. Matters covered by these Regulations include: rights of the Regulatory Commission to take natural gas free of charge at flare point; submission of a Flare Elimination and Monetisation Plan (FEMP) for approval; gas flare, vent gas and methane emissions data collection; issuance of permits and authorisations; applicable fees for gas permits; keeping and maintaining daily record of natural gas produced; offences and penalties.
