Kano State Water and Sanitation Sector Reform Law, no. 8 of 2019.

This Law, divided into eleven chapters, provides for ensuring the right of access to basic water and sanitation services, for establishing the Institutional and Regulatory Framework for the water and sanitation sector, and for specifying the roles of the Government and private sector in water affairs. The Law defines the following relevant terms: water abstraction; basic water supply; Board of any of the institutions created under the Law; Chairman of any of the Boards; State Water Regulatory Commission; consumer; distribution system; domestic supply; essential service; emergency situation; groundwater; manhole; National Water Policy; permit; pollution; private sector participation agreement; sanitation services; State Water Agencies; State-wide Water Sector Development Plan; water-related tariffs; water services; water quality standards; waterworks. Chapter II of the Law concerns the establishment of the State Water Corporation, the composition of the Governing Board of the Corporation, and the following functions of the Board: making strategic decisions on the mandate and activities of the Corporation; approving the business, plans, budgets and performance of the Corporation; approving pre-qualified Private Sector Participants in according with the provisions of the Law; monitoring the implementation of the State WASH Policy as it affects Water supply and Sanitation Management in its areas of operations; ensuring compliance with regulations and standards set by the State Water Services Regulatory Commission; approving and monitoring the implementation of the Water and Sanitation Services Development plans; proposing tariffs for water supply and sanitation management services; functions and powers of the Corporation, including: providing technical expertise to the Water and Sanitation Sector; enforcing the standards in the industry sector; managing all existing State-owned water infrastructures and assets for domestic, commercial and industrial purposes; developing, managing, operating and maintaining new water infrastructures.
Further matters covered by this Law include: funds and resources of the State Water Corporation; investments; water supply, distribution and consumption; responsibility to consumers for continuous supply of water; purchase, resale and distribution of water; payment of water rates and charges; liability in case of damaged installation works; establishment and functions of the customer care centre, including: ensuring the resolution of complaints regarding quality of water, environmental hazards resulting from the corporation's activity, damage to properties of the corporation; water abstraction by fire authorities. Chapter III concerns the establishment of the State Small Towns Water Supply and Sanitation Agency and the definition of its objectives and functions; general administration and financial provisions; water supply, distribution and consumption; payment for water rates and charges. Chapter IV concerns affirmation, composition, functions and powers of the Rural water supply and sanitation agency; financial provisions; preparation of water development plan across the country; content of water sector development plan; collaboration of the responsible ministry with other governmental authority in water sector; measures for preventing water pollution. Further Chapters concern: establishment of State Water regulatory commission; special regulatory functions; licence to operate as water services provider; standards and tariff; water services providers and consumers; penalties.
