Kwara State Environmental Protection Agency Law, no. 8 of 1991.

This Law provides for establishing the State Environmental Protection Agency and for related matters. The Law defines the following relevant terms: Local Government Committee on Environmental Protection; commercial or industrial waste; designated dumping site; domestic waste; industrial effluent; incinerator; pollution; solid waste. The Law focuses on the following matters: establishment of the State Environmental Protection Agency; meetings and procedure; appointment of members; functions of the governing council; powers of the Agency, including: carrying out all activities necessary and advantageous for the protection and enhancement of the quality of the environment in the State; monitoring and surveying water (including underground water), air, land and soil to determine pollution levels in them or to collect baseline data from them; implementing research and development activities for environmental protection; educating the general public on the types of disposal methods acceptable by the State Government for domestic and industrial wastes; carrying out toxicological tests on insecticides, herbicides and other agricultural chemicals which are new in the market, in order to check possible adverse effects on the environment; conducting environmental impact assessment of new and existing projects and make recommendations for corrective measures; establishing air quality standards; controlling noise pollution levels; applying enforcement measures to combat environmental degradation in manufacturing premises and government operations. Further matters covered by this Law include: financial measures; applications of funds; establishment of local government committee on environmental protection; issuance of permits; storage and burning of waste; purification and discharge of industrial waste; prohibition of discharge of industrial gaseous waste, and of dumping of toxic or hazardous waste; penalties and offences.
