Abstract
These Regulations, implementing sections 335 (1) and (3) of section 434 of the Merchant Shipping Act, 2007, apply to: any ship of 400 Gross Tonnage and above that is a Nigerian ship, operates under the authority of Nigeria, or is in a port, shipyard, dockyard or jetty in Nigeria or at an offshore terminal in Nigerian waters. The Regulations provide for anti-fouling systems and particularly prohibits: the application, re-application, installation, or use of harmful antifouling systems (“AFS”) on ships; the application, installation or use of such systems on ships whilst in any port, shipyard, dockyard, jetty. Further matters covered by these Regulations include: control of waste materials; communication and exchange of information; surveys and certification; issuance of an international, anti-fouling system certificate; inspection of ships; establishment and maintenance of marine Laboratory by the Nigerian Maritime Administration and Safety Agency; offences.
