Abstract
These Regulations, made under section 33 (y) of the Petroleum Industry Act, No. 6 of 2021, provide for: defining general rules for the establishment of Decommissioning and Abandonment Fund for midstream and downstream petroleum operations; regulating the decommissioning and abandonment activities of facilities in the Nigerian midstream and downstream petroleum industry; establishing sanctions and penalties. The Regulations apply to: establishment and administration of the Fund; decommissioning and abandonment of facilities used in midstream and downstream petroleum operations in Nigeria. The Regulations concern: drafting of the decommissioning and abandonment Plan; annual contribution to the Fund; content of the Plan and respect of environmental sustainability; requirements for waste disposal; application of waste hierarchy principle, and re-use and recycling; disposal of any radioactive material; environmental evaluation study report; requirements for public consultation and participation.
