Abstract
These Regulations, made under section 41 of the National Biosafety Management Agency Act, no. 20 of 2015, provide for implementing the provisions of the National Biosafety Management Agency Act, with the necessary details of regulatory and supervisory requirements, in order to facilitate the achievement of the goals for which the Agency was established. Part II of the Regulations concerns the creation of Institutional Biosafety Committees and the definition of related functions, including: reviewing of proposals for contained use, confined field trials and commercial release of Genetic Modified Organisms (GMO); reviewing of risk assessment and proposing risk management measures. Part III concerns general provisions applicable to the issuance of permits and applications, including: request of additional information; new information identifying actual risks after the grant of a permit. Part IV concerns accreditation of institutions and certification of facilities, including certification of Biosafety containment Facility.
Part V concerns permit to conduct a contained use experiment. Part VI details requirements for conducting confined field and multi-location trials, risk assessment and propose risk management measures. Part VII provides measures on application for permit to carry out commercial release of a GMO. Part VIII concerns procedures for import of GMOs for direct use as food, feed or for commercial production. Part IX defines measures for packaging and transportation of GMOs, identification and labelling. Part X concerns transit shipment of genetically modified organisms not registered in Nigeria. Further Parts concern surveillance and safeguards measures, including drafting of an emergency plan; liability; internalisation of the costs of environmental protection and application of the polluter pays principle; evaluation of damages; offences and penalties.
