Pollution (Prevention and Control) (Miscellaneous Provisions) Law [CAP. 120].

This Pollution (Prevention and Control) (Miscellaneous Provisions) Law [CAP. 120] is enacted in Ebonyi State to regulate and mitigate pollution from industrial and domestic sources. It prohibits the siting of industries emitting hazardous gases or excessive noise near residential areas and mandates proper disposal of industrial waste, including the use of treatment plants. Industries are required to submit environmental impact statements for major proposals and store solid waste in a sanitary manner. The Law also bans dumping waste in rivers, streams, highways, and near water sources, and requires road construction companies to refill burrow pits after use.
The Law extends to domestic pollution, mandating water closet systems in industries and proper drainage for wastewater. It prohibits acts such as street urination, defecation in unapproved places, littering, and fishing with chemicals. Commissioners are empowered to make regulations on environmental safeguards, including watershed management, air quality, and erosion control. Offences under the law attract fines ranging from ₦10,000 to ₦200,000, with additional daily penalties for continued violations.
